1. General Information
In compliance with Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), we inform you that the domain www.wosler.eu (hereinafter, the “Portal”) is owned by SMART HEALTH DIGITAL APP S.L., a company registered in the Commercial Registry of Granada, Volume 1860, Folio 25, Sheet GR-60.543, with registered address at C/ Alhóndiga, 6, 5ºC, 18001 Granada (Spain), and tax ID B67918151 (hereinafter, “WOSLER”).

2. Purpose of the Portal
The Portal aims to provide information about the digital medical assistance service that allows users to access a remote consultation with a licensed healthcare professional by purchasing the service through an integrated payment gateway.
WOSLER does not provide medical services. Its role is strictly technical and operational, facilitating user access to accredited, independent, licensed physicians in accordance with current regulations. Under no circumstances shall WOSLER be considered part of the doctor-patient relationship, nor shall it provide diagnoses, treatments, or clinical guidance of any kind.
3. Acceptance of Terms
Browsing, accessing, or using the Portal implies the user’s express and unconditional acceptance of these terms, as well as the Privacy Policy and Cookie Policy available on the site.
By using this website, the user declares they have read, understood, and fully accepted these terms and agrees to act in accordance with the law, good faith, morality, and public order.
Any person who does not accept these conditions must refrain from using the Portal or contracting any of the services it offers.
4. Access to the Portal and Legal Capacity
Access to the Portal is restricted to individuals of legal age who possess full legal capacity under Spanish law.
The user declares they are at least 18 years old. While the medical assistance service may be intended for individuals aged 16 and over, only adults may complete the purchase of the service.
5. Contracting the Digital Medical Service
The digital medical assistance service is contracted through a one-time payment via the Portal’s integrated payment gateway.
Once payment is successfully completed, the user automatically accepts the Portal’s Terms and Conditions and the terms of the medical assistance service, both available for consultation on the website prior to payment.
WOSLER receives automatic notification via email from Stripe in case of successful payment. If payment is declined or not completed, the user will not be entitled to receive the service.
No user account or registration is created on the Portal. The service is for one-time use and does not require account creation.
6. Data Storage
The only personal data collected through the Portal are those strictly necessary to issue an invoice (such as name and email address).
This data is collected and stored within the payment gateway solely for that purpose.
WOSLER does not create medical records or store any health information. All aspects of the medical consultation are the sole responsibility of the attending physician, who is not an employee of WOSLER and has no contractual relationship with the company.
7. Nature of the Service and Medical Liability Disclaimer
WOSLER’s role is to provide users with access to independent, licensed physicians for remote consultations.
WOSLER does not provide medical advice or intervene in any stage of the medical act.
Physicians provide care independently, based on their own clinical judgment and under their legal responsibilities as licensed professionals.
WOSLER shall not be held directly or indirectly liable for the results of medical consultations, diagnoses, prescriptions, or any consequences arising from the medical act.
Any complaints or claims must be addressed directly to the attending physician.
8. Technical and Legal Limitations
WOSLER does not guarantee uninterrupted access to the Portal or the absence of errors. It is not liable for technical issues arising from use of the Portal, including viruses, network interruptions, server failures, or other incidents beyond its reasonable control.
Use of VPNs or other tools to conceal or alter geographic location in order to access the service from jurisdictions where it is not permitted is strictly prohibited.
The user will be solely responsible for any legal violations resulting from such actions.
9. Payment Processing Responsibility
Payment is processed through an external gateway managed by Stripe, a certified and secure platform.
WOSLER does not have access to users’ full credit card details and does not store sensitive financial information.
WOSLER is not liable for technical errors, service disruptions, duplicate charges, payment failures, or any other issue attributable to the payment gateway.
In the event of an error, the user must contact Stripe or their card issuer directly.
If payment is not successfully completed, the user will not be entitled to the digital medical service—even if they received confirmation through other channels.
Only payments confirmed by Stripe through electronic notification to WOSLER grant the right to receive the service.
10. Third-Party Links
The Portal may contain links to external websites not operated by WOSLER.
WOSLER has no control over such sites and is not responsible for their content, legality, or technical availability.
The inclusion of such links does not imply any affiliation or recommendation by WOSLER.
11. Intellectual Property
All content on the Portal—including text, images, logos, software, graphic design, color schemes, and navigation structure—is the property of WOSLER or its respective owners.
Reproduction, distribution, or public communication of any content is strictly prohibited without prior written authorization from the rights holder.
12. Jurisdiction and Applicable Law
These terms are governed by common Spanish law.
If the user is a natural person, any dispute will be resolved by the courts of the user’s place of residence.
If the user is a legal entity, both parties expressly submit to the courts of Granada, waiving any other jurisdiction that may apply.
